Nippon Telegraph and Telephone East Corporation and Nippon Telegraph and Telephone West Corporation have provided the Disaster Broadband Message Board (Web 171), which enables messages (text, voice, images) to be recorded and viewed in an Internet environment when disasters occur. We have now made this service even more convenient and will hereafter provide it under the name, Disaster Message Board (Web 171).

 Below are the rules that must be observed to use the Disaster Message Board (Web 171). Before using this service, users must agree to these rules.

Rules for Using the Disaster Message Board (Web 171)

 These rules (hereafter, “Rules”), stated below, cover all matters related to using the Disaster Message Board (Web 171) (hereafter, “Message Board”) provided by Nippon Telegraph and Telephone East Corporation and Nippon Telegraph and Telephone West Corporation (hereafter jointly referred to as the “Company”). Before using the Message Board, customers (hereafter, “Customer” or “Customers”) must agree to the Rules. Moreover, the Rules may be changed without prior notice. In such a case, the Customer shall agree to be bound by the changed Rules.
 Furthermore, should this service subsequently become some similar service such as another company's message board, the Rules for using that service will apply.

1. The Message Board is provided to enable Customers to confirm each other’s safety. It is not provided to guarantee that certain communications can be carried out.

2. Messages can be recorded and viewed on the Message Board only during the periods that the service is provided, which the Company will separately announce. During other periods, only user registration and the updating and deleting of the registration can be performed.

3. Even in the event that other disaster message board services are provided by another company-such as a mobile phone company (hereafter, “Another Company’s Message Board Service”), there may be a case in which a third party can search for the existence of information or for information recorded on the Message Board by Customers, and the search result can be shown on Another Company’s Message Board Service.

4. When the service’s email and telephone notification function or its recorded message notification function is used, email and telephone notifications may be delayed or not arrive at all depending on the telecommunications network or email-receiving environment, the receiver’s settings, or some other reason. In certain cases, moreover, the receiver of an email or a telephone call may be charged a telecommunications fee or a call fee.

5. The Company shall not be liable for any damage that occurs because the Customer makes a mistake in recording the intended recipient(s) of his/her email or telephone notifications, or because the Customer is negligent in updating his/her registration information such that personal information is leaked and trouble occurs with another individual or with a company, or because of any other reason for which the responsibility lies with the Customer.

6. Information recorded on the Message Board may be viewed by an indefinite number of people. If the Customer wishes to restrict access to his/her information, he/she must register accessibility limits in advance and establish a password for viewing the information on his or her own responsibility.

7. Regardless of whether the Customer has established a password, the Company shall bear no responsibility whatsoever for any result of the Customer disclosing personal information on the Message Board, except when the result derives from intention or gross negligence on the part of the Company.

8. In using the Message Board, the Customer shall bear full responsibility for the use of his/her phone number and the name and password corresponding to the phone number, and for managing the email addresses and names of the email recipients registered for the Customer’s email account and the names and phone numbers of the telephone call recipients registered for the Customer’s phone number.

9. The Company shall bear no responsibility whatsoever for any damage incurred by the Customer from the Customer’s password or other information being used by another Customer or a third party, except when the damage results from intention or gross negligence on the part of the Company.

10. The Customer may not carry out any of the acts or activities listed below. Moreover, should the Company determine that an act or activity of the Customer corresponds to any of those listed below, the Company may delete the Customer’s messages, and prohibit the Customer from recording any further messages, without providing the Customer any advance or after-the-fact notification or explanation.

 ・Pretend to be a different person or an officer or system maintenance worker of the Company.

 ・Send or post images, pictures, sound or text involving lascivious acts, child pornography or child abuse; sell media on which such is recorded; or post or send advertisements that evoke sending, posting or selling such.

 ・An act that constitutes a crime such as fraud or child prostitution, or that is linked to the same.

 ・Set up a pyramid scheme or invite participation in one.

 ・Falsify or delete the Company’s or other people’s information that is accessible from the Message Board.

 ・Access, without due authority or without restriction, equipment of the Company or of other people (including but not limited to the telecommunications equipment, telecommunications circuits, electronic computers, and other machines, and software, used by the Company for providing the Message Board), or interfere with the use or operation of such equipment.

 ・Collect another person’s personal information without obtaining that person’s consent, or by fraudulent means.

 ・An expression or act that infringes the rights (including but not limited to property rights, privacy rights, copyrights, the right to the protection of one’s honor, and portrait rights) of another Customer or a third party.

 ・Engage in business activities (including but not limited to advertising and solicitation) or in selling and purchasing activities (regardless of whether the purpose is profit).

 ・Pre-election campaigning, election campaigning, or similar activities; activities that violate the Public Offices Election Act; activities related to politics or religion.

 ・An act that infringes or might infringe the Company’s or an individual’s copyrights, trademark rights, or other intellectual property rights.

 ・Unjustly discriminate against, or slander or insult, another person; abet the unjust discrimination against another person; or damage the honor or reputation of another person.

 ・Commit an act that is linked, or that is likely to be linked, to a drug crime or to abuse of a controlled substance, or advertise an unapproved drug.

 ・Advertise for making monetary loans without first registering to operate a moneylending business.

 ・Impersonate someone else in using the Message Board.

 ・Send or post a virus or some other harmful computer program.

 ・Send another person an email advertisement, solicitation or publicity without permission, or send another person an email that, given commonly accepted norms, will or is likely to cause a feeling of repugnance.

 ・An act that interferes, or that might interfere, with another person’s computer equipment or with the use or operation of Internet connection equipment.

 ・Invite or entice others to engage in illegal gambling or gaming.

 ・Undertake, mediate or solicit the commission of a crime (transfer of a firearm to another person, unlawful manufacture of an explosive, providing of child pornography, forgery of an official document, murder, coercion, etc.).

 ・Send, to an indeterminate number of people, information that, based on commonly accepted norms, will inspire a feeling of revulsion - such as images of a murder scene, images of animals being killed, wounded or tortured, or other such ghoulish information.

 ・Invite or entice others to commit suicide, introduce methods of suicide that might cause harm to the third party.

 ・Create a link that facilitates, or that is intended to facilitate, any of the acts or activities mentioned above, despite knowing that the act or activity is governed by any provision of the Rules .

 ・Abet efforts to have people post or send information that is linked, or that is probably linked, to a crime or an illegal act, or information that unjustly slanders or insults another person or violates another person’s privacy.

 ・Interfere with the provision of the Company’s services or damage the Company’s reputation.

 ・Any other act or activity that the Company judges to violate public order and morals or infringe the rights of another person.

11. When a message is deleted based on the provisions in the previous section, messages recorded subsequently to the deleted one may also be deleted, regardless of their content.

12. Regardless of their content, the Customer may record a maximum of 20 messages on the Message Board. After that, when the next one is recorded, the first one will be deleted.

13. When the Company discontinues providing the Message Board, all of the messages on it will be deleted.

14. To the email address included in the basic information registered at the time of user registration, the Company will send an email requesting confirmation. If confirmation is not provided within the period stated on the email, the user’s registration will be cancelled.

15. The Company shall not be liable for any damage incurred by the Customer from using the Message Board (including lost profit and damage from claims, or from demands for compensation, made against the Customer by another Customer or a third party) or any damage incurred by the Customer or another person from being unable to use the Message Board, except when the damage results from intention or gross negligence on the part of the Company.

16. Given the nature of the Message Board, the Company makes no guarantees regarding the completeness, accuracy, reliability, etc., of the information recorded on it by Customers.

17. The Company may temporarily stop providing the Message Board, without first notifying the Customer or obtaining the Customer’s consent, for any of the following reasons.

 ・The Company conducts system maintenance or other work on the Message Board.

 ・It becomes impossible for the Company to operate the Message Board because a natural disaster or some other serious event has occurred or is likely to occur.

 ・The Company decides, for some other reason related to operation of the Message Board, that temporarily ceasing to provide the Message Board is necessary.

18. The Company shall have nothing to do with any dispute about an infringement of intellectual property rights (copyrights, trademark rights, etc.), personal rights (privacy rights and the right to protection of one’s honor and reputation, etc.), or contractual rights that occurs, between the Customer and another Customer or a third party, in connection with information which the Customer uses or provides through the Message Board. The Customer shall be responsible for resolving the dispute at his or her own expense and responsibility.

19. These Rules, in their entirety, including their establishment, validity, interpretation and performance, shall be governed by the laws and regulations of Japan. Should part of these Rules be deemed invalid due to the mandatory provisions of consumer protection laws and regulations or other mandatory provisions, the remaining parts that do not violate such provisions shall have validity to the maximum extent possible under the law.

20. Guidelines for Handling Personal Information

(1) Purposes of use
 The Company will use the personal information that it handles, in operating the Message Board, for the purposes stated below. (“Personal information” here refers to personal information as stipulated in Article 2 of the Act on the Protection of Personal Information, and includes personal data and retained personal data. For Customers who are not individuals but rather companies, it also includes the personal information, of company representatives, officers, employees, that the Company handles when providing and selling telecommunications services)

[1] Providing of Message Board
 The Company will use the types of personal information listed below, which it handles in providing the Message Board, to the extent necessary to do the following: carry out measures (such as questionnaire surveys) for improving CS (customer satisfaction); plan and develop new telecommunications services; manage and improve the equipment necessary for providing telecommunications services; and conduct other operations related to the Company’s telecommunications services.

・Customers’ names, addresses, phone numbers, email addresses, etc.
・Information, on Customer equipment use, that is necessary for dealing with equipment problems
・Other personal information that is included in the information which the Company handles as a result of Customers’ use of the service and their inquiries

[2] Providing Customer Service, etc.
 The types of personal information listed below, which the Company receives and handles when Customers contact the Company’s Customer Consultation Center or other customer support venues concerning customer service or requests (including for dealing with problems), will be used to the extent necessary to provide customer service and deal with the requests. Customer opinions, and information from providing customer service, will also be used to the extent necessary to improve the quality of the Company’s telecommunications services and develop new telecommunications services.

・The names, addresses, phone numbers, email addresses of Customers who contact the Company in connection with customer service or requests.
・Other personal information obtained in providing customer service and answering requests

[3] Participation in questionnaire surveys, etc.
 The types of personal information listed below, which the Company receives and handles as a result of Customer participation in questionnaire surveys conducted by the Company, will be used to the extent necessary to improve the quality of the Company’s telecommunications services and develop new telecommunications services.

・The names, addresses, phone numbers, email addresses, age, date of birth, occupation, sex, and other information provided by Customers when participating in questionnaire surveys
・Other personal information obtained in providing customer service and answering requests

[4] Subcontracted business activities
 The personal information which the Company handles in conducting business activities subcontracted to it by other companies (such as selling and distributing other companies’ products and services) will be used to the extent necessary to carry out those activities.

(2) Providing personal information when outsourcing business activities to other companies
 Based on the provisions Article 23, Paragraph 4, Section 1 of the Act on the Protection of Personal Information, the Company may provide the personal information it handles to other companies to which it outsources business activities. In such a case, the personal information provided will correspond to that listed above in [1] - [4] of (1). When outsourcing business activities, the Company will choose companies that can be relied upon to handle personal information properly. Moreover, the Company will stipulate, in contracts with the companies, terms regarding safe management measures, confidentiality, subcontracting, and other matters necessary for ensuring that personal information is handled properly, and will also appropriately supervise the companies.
 Based on the provisions in the Act on the Protection of Personal Information, the Telecommunications Business Act, and other laws and regulations, the Company may also provide personal information that it handles to third parties.
